The national personal injury law firm Morgan & Morgan is facing a lawsuit filed by Brandon Walker of the McIntosh County Sheriff's Office in Georgia. Walker alleged in a July 19 complaint that a Morgan & Morgan attorney gave him misleading advice.
Walker was "seriously injured" in 2022 when his sheriff’s deputy cruiser was hit from behind by another vehicle on I-95, according to the complaint. He was airlifted from the scene for emergency treatment, hospitalized, and left with a permanent back injury. His medical expenses from the accident totaled "no less than $50,000." Walker was contacted by State Farm, the insurance provider for the driver that hit his vehicle. State Farm told Walker they could pay him the $25,000 insurance coverage limit but would need the name of the attorney representing his interests.
According to the complaint, Walker had seen billboards advertising Morgan & Morgan Jacksonville throughout southern Georgia and reached out to the firm. He was informed that Morgan & Morgan attorney Brad Milkwick, who is named as a defendant in the case, would handle his worker’s compensation claim. Milkwick told Walker that in order to be entitled to worker’s compensation, he would have to quit his job with the McIntosh County Sheriff's Office, which Walker said he did not want to do. "No other effort was made by Defendant Milkwick to understand Plaintiff’s situation or help in regard to a workman’s compensation claim - it was literally one extremely short phone call. In fact, this advice breached the standard of care," according to the complaint.
Morgan & Morgan Jacksonville did not "explore other possible sources of compensation" for Walker’s injuries, according to the complaint. The complaint alleges that "any proper investigation" would have found that the driver who hit Walker’s vehicle was a "severe diabetic." Weeks prior to hitting Walker’s vehicle, the other driver had been in a one-car accident that resulted from diabetic medication complications. Despite the earlier accident, the driver’s medical provider had never advised him against driving.
Additionally, according to the complaint, at the time of this incident, Morgan & Morgan’s Jacksonville office was not registered to do business in Georgia. "Defendant Morgan & Morgan Jax could not carry out its contractual obligations to Plaintiff as it was not qualified or registered with this State," said Walker's complaint. He is now bringing the case as a class action on behalf of himself and any other individuals who retained Morgan & Morgan Jacksonville’s services before April 2023 when their office became properly registered with Georgia.
